Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.
1. Accounts and Subscription
1.1 Account Creation. To use Scoreboardz, you must purchase a subscription. You agree to provide accurate, current, and complete information during the checkout process.
1.2 Subscriptions. The Service is billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis (either monthly or annually). Billing cycles are set either on a monthly or annual basis, depending on the type of subscription plan you select when purchasing a Subscription.
1.3 Cancellation. You may cancel your Subscription renewal either through your online account management page or by contacting our customer support team. You will not receive a refund for the fees you already paid for your current subscription period and you will be able to access the Service until the end of your current subscription period.
2. License to Use
Subject to your compliance with these Terms, Phenomenash LLC grants you a limited, non-exclusive, non-transferable, non-sublicensable license to download and install a copy of the Application on a computer that you own or control and to run such copy of the Application solely for your own personal or internal business purposes.
3. Restrictions
You agree not to, and you will not permit others to:
- License, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose, or otherwise commercially exploit the Service or make the Service available to any third party.
- Modify, make derivative works of, disassemble, decrypt, reverse compile, or reverse engineer any part of the Service.
- Remove, alter, or obscure any proprietary notice (including any notice of copyright or trademark) of Phenomenash LLC or its affiliates, partners, suppliers, or the licensors of the Service.
4. Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of Phenomenash LLC and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.
5. Termination
We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.
6. Limitation of Liability
In no event shall Phenomenash LLC, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content.

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
8. Governing Law
These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
